These Terms of Service govern your use of torqnz.com and purchases made from TORQ.

By using this website or placing an order, you agree to these terms.

Eligibility

You must be legally capable of entering into a binding contract to place an order.

Where you purchase on behalf of a business, you confirm that you are authorised to bind that business.

Product information

We take reasonable care to ensure product descriptions, compatibility information, photographs, specifications and prices are accurate.

Colours, finishes and appearance may vary slightly because of lighting, displays, manufacturing batches and normal production tolerances.

Installed vehicle photographs may show other products or accessories not included with the purchased item.

Only the items expressly listed in the product description are included.

Vehicle compatibility

TORQ bonnet mounts and some other products are vehicle-specific.

Before ordering, you must check:

• vehicle make;
• model;
• production year;
• generation or chassis;
• body style where relevant;
• mounting side; and
• any compatibility notes shown on the product page.

Vehicle registrations and production dates do not always align exactly with model generations. Contact us before ordering if you are uncertain.

We are not responsible for an incorrect product selection based on incomplete or incorrect vehicle information provided by the customer, except where TORQ supplied incorrect advice or otherwise has responsibility under applicable law.

Installation

Products must be installed securely and in accordance with instructions, vehicle manufacturer requirements and applicable laws.

Installation may require tools and mechanical judgment. If you are not confident carrying out the installation, use a suitably qualified automotive installer.

The customer is responsible for checking that:

• the product is secure;
• cables are safely routed;
• bonnet, wipers, doors and other vehicle systems operate freely;
• the installation does not interfere with airbags, sensors, visibility or other safety systems;
• fasteners remain tight; and
• the vehicle remains legally compliant.

Nothing in these terms excludes responsibility that TORQ cannot lawfully exclude.

Orders

Submitting an order is an offer to purchase.

We may accept or decline an order for legitimate reasons, including:

• stock errors;
• pricing or listing errors;
• suspected fraud;
• payment failure;
• delivery restrictions; or
• inability to supply the product.

A payment confirmation or automated email does not prevent us from correcting an obvious error. If we cannot fulfil an order, we will cancel the affected item and refund the amount paid.

Pricing and payment

Prices are displayed in the currency shown on the website.

Applicable taxes, shipping fees and discounts are shown at checkout.

You must provide accurate payment and billing information and confirm that you are authorised to use the selected payment method.

Third-party payment options such as Shop Pay, Google Pay, PayPal or buy-now-pay-later providers are also subject to those providers’ terms.

Promotions and discount codes

Discount codes:

• must be entered before completing checkout;
• cannot be redeemed for cash;
• may have expiry dates or product exclusions;
• may not be combined unless expressly allowed; and
• may be withdrawn where used fraudulently or contrary to the promotion terms.

Order cancellation

Contact us immediately if you wish to cancel or amend an order.

We may be unable to cancel an order after packing or dispatch. Returned products will then be handled under our Return and Refund Policy.

Delivery

Delivery estimates are not guarantees unless expressly stated otherwise.

Risk and responsibility for delivery will be determined in accordance with applicable law and our Shipping Policy.

Intellectual property

All website content, including the TORQ name, logo, product photography, graphics, written content, product designs, renders, part-number system and branding, is owned by or licensed to TORQ.

You may not copy, reproduce, modify, distribute, sell or commercially use our content without written permission.

Reviews and customer content

If you provide a review, photograph, video or other content, you confirm that:

• it is truthful;
• you have the right to provide it;
• it does not infringe another person’s rights; and
• it is not unlawful or misleading.

Where you separately give us permission to use customer content, you grant TORQ a non-exclusive licence to reproduce and display that content for marketing and promotional purposes.

We will not claim permission merely because you privately send us a support photograph.

Website availability

We do not guarantee that the website will always be uninterrupted or error-free.

We may modify, suspend or discontinue parts of the website for maintenance, security, stock management or business reasons.

Liability

Nothing in these terms excludes or limits any guarantee, remedy or liability that cannot lawfully be excluded, including rights under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.

Subject to those rights, TORQ is not liable for loss caused by:

• incorrect installation;
• unauthorised product modification;
• incorrect vehicle selection by the customer;
• use outside the product’s stated purpose;
• failure to inspect or maintain the installation;
• third-party products or services; or
• events outside our reasonable control.

Business purchases

Where products are acquired for business purposes, the parties may contract out of the Consumer Guarantees Act only where the legal requirements for contracting out are met, including that the agreement is in writing and fair and reasonable.

Unless those requirements are met, the Act continues to apply.

Governing law

These terms are governed by the laws of New Zealand.

Nothing in this clause removes rights a consumer may have under mandatory laws applying in their country of residence.

Changes to these terms

We may update these terms from time to time. The version published when an order is placed will normally apply to that order.
